Disclaimer and Warranty
Limited Warranty
Poseidon Racks LLC (“Poseidon Racks”) warrants to the original purchaser that the product will be free from defects in workmanship and materials for a period of thirty (30) days from the date of purchase. This limited warranty is made in lieu of all other warranties and covers only the Poseidon Racks product. This limited warranty is void if the product is (i) installed, operated, or stored improperly or under abnormal conditions; (ii) repaired, modified, or altered by someone other than Poseidon Racks; or (iii) abused, neglected, or damaged.
In the event of a possible warranty claim, you must call us at (757) 418-5214 or email us at Poseidonracks.com to obtain a return authorization. All requests for a return authorization must be received within the limited warranty period. If proven to be defective upon Poseidon Rack’s inspection, the product will be repaired or replaced and shipped back to you. At Poseidon Rack’s option, the original purchase price may be refunded to the original purchaser. All shipping costs must be paid by you and we reserve the right to deduct from any refund all costs of shipping. Your sole remedy with respect to defective products is, at our election, is repair, replacement or refund as described above.
POSEIDON RACKS MAKES NO OTHER REPRESENTATIONS OR WARRANTIES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, POSEIDON RACKS EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES SHALL POSEIDON RACKS’ LIABILITY, WHETHER BASED ON CONTRACT, TORT, WARRANTY, STRICT LIABILITY, OR ANY OTHER THEORY, EXCEED THE PRICE OF THE INDIVIDUAL PRODUCT WHOSE DEFECT OR DAMAGE IS THE BASIS OF THE CLAIM. POSEIDON RACKS SHALL NOT BE RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, REGARDLESS OF WHETHER POSEIDON RACKS IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Product Warnings
Do not store items on rack other than floating water mats. Storing other items on rack may result in serious injury, death, or property damage.
Not for use with floating water mats greater than 16 ft. Storing larger floating mats may result in serious injury, death, or property damage.
Never store items on rack with a weight greater than 30 lbs. Storing items greater than 30 lbs may result in serious injury, death, or property damage.
Always remove rack before transporting boat. Transporting boat with rack attached can cause the rack or product stored to become loosened or detached, which may result in serious injury, death, or property damage.
Always ensure rack and stored item are away from other objects or guiderails that may catch or snag rack or product when docking boat and loading boat on a trailer. If rack or product stored hit, catch, or snag other objects or guiderails, serious injury, death, or property damage may occur.
Always use safe boating practices when using rack. Speeding, sharp turns, jumping, or other aggressive maneuvers may cause rack or product stored to become loosened or detached, which may result in serious injury, death, or property damage.
